On April 5, a landmark event occurred in the field of automobile circulation.


Minister of Commerce Zhong Shan signed Order No. 1 of 2017 and issued the "Measures for the Administration of Automobile Sales", which will be implemented from July 1, 2017. At the same time, the "Implementation Measures for the Administration of Automobile Brand Sales" issued in 2005 was abolished.


The new "Measures" mainly made a number of reforms for market channel brands, and the voice of public opinion is more biased to support, but we look back and think carefully, maybe the new "Methods" are still not perfect!

Breaking the single system of brand authorization sales?


The main reform point of the new "Measures" is to break the single system of brand authorized sales! To a certain extent, it can indeed break the behavior of forcible or disguised price increases in some 4S stores in the market today. Under the current system, manufacturers are very tight in sales KPIs, and they also bundle sales of popular models and unpopular models, and the profit of bicycle sales is not high! At the same time, some brands with less-than-ideal sales will have a large amount of inventory accumulation, which will cause the 4S store funds to break. This is undoubtedly forcing the 4S shop to change its own way of "self-reliance", but the wool comes out of the sheep, and it is the consumers who suffer finally

After the implementation of the new "Measures", the sale of automobiles will no longer be based on the premise of brand authorization, and the implementation of authorized sales and unauthorized sales will be implemented in parallel to promote diversified sales models, in order to promote market competition, reduce circulation costs, improve circulation efficiency, The goal to stimulate market vitality. And each 4S shop seems more free, you can sell models of other brands at will, without restriction!


But let's think about what the 4S shop is based on. Brand endorsement and manufacturer warranty! Belly black said that even if the country breaks the single system of brand authorization and sales, but which brand do you think is willing to sell other products in its own 4S store, the brand will definitely secretly prevent this from happening internally. And taking a step back 10,000 steps said that some brand prime ministers can support the boat, allowing multi-brand sales policies to land. However, the warranty and maintenance mechanism is different between different brands. Will the future maintenance and repair responsibility become another bigger problem? At the same time, under the existing mechanism, most of the profits of 4S stores can no longer be obtained by pure sales behavior, and without the funds and technical support of the brand behind, can the 4S stores or distributors be protected in terms of profits How about it? There is also a big problem!

So how to strengthen consumer rights protection?


Chapter 2 and Article 14 of the new Measures clearly stipulate that “Dealers shall not restrict the location of consumers’ household registration, and shall not restrict consumers to suppliers and after-sales service providers of products such as auto parts, supplies, finance, insurance, and rescue, but Except for the “Three Guarantees” service and recall of family car products, except for accessories and services used by the supplier at the expense of the supplier. When dealers sell cars, they must not force consumers to purchase insurance or provide them with services such as vehicle registration. When consumers encounter unfair treatment in the future, they can have a strong guarantee at the legal level.


1. Off-site purchase of first-tier cities. The discount rate for car purchases will be greater than that for other places. Due to the effects of household registration or residence, many people can only "run near and far" to run farther and buy more expensive cars! After the introduction of the new "Measures", consumers will be greatly facilitated, and of course, the demand for car purchases in surrounding cities will flood into large cities at once, and a seller's market will be formed in a short time. But in the end, it will definitely be balanced in the relationship between supply and demand. In the end, it will still benefit from just buying off-site cars.


2. Miscellaneous other expenses. Buying a car in 4S shop is covered by full insurance, license fees, additional parts, and designated maintenance in the future. It is an unspoken rule in the industry, but in the face of such overlord clauses, we are helpless. In the case of one price in the east and one price in the west, the final bill will be tens of thousands more in minutes. However, under the new "Measures", as long as the dealers dare to act in an unreasonable manner and retain evidence of random charges by the merchants, everything will be discussed in court.


3. Certificate of conformity Article 16 of Chapter 2 of the new Measures clearly stipulates the provision of a certificate of compliance with the vehicle. What is a certificate of conformity? Cars must be qualified on the license plate. Without a license, they can only use temporary licenses and cannot apply for a formal license! But for many 4S stores, they often do not have so much liquidity to buy such a large number of cars, so many 4S stores often take the mortgage bank of the certificate for loans! As a result, consumers often fail to obtain a certificate immediately, which affects the licensing. After some consumers paid the full payment, the 4S shop closed down due to a financial breakdown, and the bank confiscated the certificate as collateral, resulting in no way for the vehicle to be licensed. After the implementation of the new Measures, it is believed that this phenomenon will be alleviated.


Finally, I will go back to the point mentioned at the beginning, the Three Guarantees problem! In the new "Measures", which clearly mentions after-sales service providers, there is only Article 13 in Chapter II! However, it only states that the after-sales service provider should clearly indicate the technology, quality and service specifications of the after-sales service to consumers. Who is the real after-sales service provider? No one can tell right now! And such unobvious regulations have left many consumers and even dealers scratching their heads! In short, the Three Guarantees problem has not been solved in a day, and whether the breaking of the single brand system advocated by the new "Measures" can bring benefits to consumers remains to be considered! But this is more of a dealer matter, and after July 1st, our consumers can finally say no to all kinds of arbitrary charging items, which is worthy of praise.
